National Conference leader and Lok Sabha MP from Srinagar Aga Syed Ruhullah Mehdi has said he will submit a notice seeking impeachment motion against Allahabad High Court judge Shekhar Kumar Yadav over his recent comments against Muslims at a VHP event. .
Allahabad High Court Justice Shekhar Kumar Yadav sparked controversy last week by saying that the country will work according to the will of the majority of Indians.
Mehdi had said on December 10 that he had the support of members of the Congress, Samajwadi Party, DMK and Trinamool Congress in the opposition camp for the impeachment motion.
“I am moving an impeachment motion in Parliament in accordance with Article 124(4) of the Constitution to remove Shekhar K Yadav, a sitting judge of the Honorable High Court, Allahabad, on the above charges. Notice,” Mehdi said in a post on X.
Justice Yadav delivered a lecture on the constitutional need for a Uniform Civil Code at an event organized by the Vishwa Hindu Parishad (VHP) in Prayagraj.
“I have no hesitation in saying that this is India, this country will work as per the wishes of the majority living in India. This is the law. You cannot say that you are saying this as a High Court judge. In fact the law works according to the majority. Look at it in the context of family or society…only the welfare and happiness of the majority will be accepted,” he said while speaking at the event, according to legal news website Live Law.
‘Support of 100 MPs’
Mehdi said he has secured the support of seven members but he needs the support of 100 members to sign the notice of impeachment motion.
“I need signatures of 100 members to move this proposal forward. More than 7 members including Asaduddin Owaisi Sahab, Honorable MP from Rajasthan Shri Rajkumar Roat, Honorable MP from Bihar Shri Sudhama Prasad Ji, Honorable MP from Uttar Pradesh Zinaab Mohibullah Sahab and Honorable MP Zinaab Zia Rahman Sahab from Uttar Pradesh UP signed it. And I thank them for their support and signatures,” Ruhollah Mehdi said.
Criticizing the remarks of the High Court judge, Owaisi had said that the Constitution of India is not majoritarian but democratic. “In democracy, the rights of minorities are protected. As Ambedkar had said ‘…just as a king has no divine right to rule, a majority too has no divine right to rule’,” the Hyderabad MP said.
