No Detention Policy: The Education Ministry on Monday decided to end the ‘No Detention Policy’ for class 5 and 8 students. PTI quoted officials as saying that this will be applicable to those students who fail in the year-end examinations. The Center further announced that no child will be expelled from any school until he completes elementary education.

There has been an official amendment to the Right of Children to Free and Compulsory Education (RTE) Rules, 2010. According to the new rules, the Central Government has given the power to the state governments to conduct regular Examination For class 5 and 8 students, but from now on if students fail to pass the annual examinations they will be taken into detention.

This amendment is contrary to the “no-detention” policy, which has been a cornerstone of India’s educational structure. RTE Act which puts no-detention It was implemented in 2009.

Amendment in RTE rules

Let us know what important amendments have been made in the RTE rules. The Right of Children to Free and Compulsory Education Act (RTE Act) was last amended in 2019.

Recent changes in RTE Act Will come after five years, under which state governments have the right to conduct annual examinations for class 5 and 8 students at the end of every academic year.

If a student does not pass these examinations, additional learning support will be provided, and a second chance to sit for the re-examination will be given after two months. Promotion of the student to the next class depends on standardized promotion criteria. If a student fails to meet the criteria despite a second opportunity, the child will be detained.

Some states support this change, including Gujarat, Odisha, Madhya Pradesh, Jharkhand, Karnataka and Delhi. While others expressed displeasure at the change. Kerala argued that this could increase pressure on young learners.
