Government clarifies whether booking bike taxi from Ola, Rapido is legal or illegal

New Delhi. There is big news for those commuting to office by booking bike taxi through Ola, Uber or Rapido. The Road Transport Ministry has made it clear whether running a bike taxi is legal or illegal. Till now there were a lot of differences among the states on this issue. While some states allowed running bike taxis, bike taxis were banned in big cities like Delhi-Mumbai. But, now the ministry has clarified the situation in this regard.

The Ministry of Road and Transport has clarified in a guideline issued for the states on Thursday that bike taxi i.e. motorcycle also comes under the definition of ‘contract carriage’ under the Motor Vehicles Act, 1988. According to the Motor Vehicles Act, ‘contract carriage’ is a vehicle for carrying passengers on hire under a specific agreement. The ministry, in its advisory issued to states on bike taxis, has said that some states and union territories are considering motorcycles as ‘contract carriage’ while processing applications for permits.

Now bike taxi has become legal
The ministry said, ‘It is clarified that as per Section 2(28) of the Motor Vehicles Act, vehicles smaller than four wheels with engine capacity more than 25 cc also come under the definition of motor vehicles. In this respect, ‘motorcycle’ also comes under the scope of Section 2(7) of the Act. Contract carriage agreement means the hiring of a vehicle at a fixed price depending on distance or time, with or without a route.

Clear instructions given to the states
In this situation, the Ministry has advised all the States and Union Territories to accept the applications for contract carriage permits for motorcycles as per the provisions of the Motor Vehicles Act and take action on them as per the rules. Till now there were many misconceptions among the states in this matter and all the states were imposing permissions and restrictions in their own way.

Where was it issued and where was it banned?
Currently, many startups including Ola, Uber and Rapido are providing bike taxi facilities. Due to lack of clear rules and laws on this, there was no uniformity among the states. While states like Goa, Telangana, Rajasthan and UP allow bike taxis, bike taxis were banned in big states like Delhi and Maharashtra. States like Karnataka did not allow petrol bikes to run as taxis, but e-bikes have a permit to run as taxis. Similarly, in some states it has also been made mandatory to install yellow number plates for bike taxis.

If we look at the figures of the Central Government, there are currently about 36 crore vehicles in the country, out of which 26 crore are two-wheelers. Bike taxi running companies expressed happiness over this decision of the government. Rapido spokesperson said, the common man will benefit the most from the legalization of bike taxis. This will not only provide a cheaper option to the travellers, people will also get new options to earn money. The co-founder of Bounce, a startup that provides bike taxi facilities, says that many states did not allow bike taxis. But, now its path has become clear.
