New Delhi. After a long time, good news has come for Google. In fact, the National Company Law Appellate Tribunal (NCLAT) on Friday reduced the fines imposed on Google from Rs 936.44 crore to Rs 216.69 crore to misuse its leading position in relation to the Play Store policies in relation to the Play Store policies.
A bench of NCLAT Chairperson Justice Ashok Bhushan and technical member Arun Baroka partially retained the conclusions of the CCI of 2022 against the Parent Company of Alphabet Inc. Google has already deposited 10% of the revised fine and the remaining amount has been instructed to pay within 30 days.
What did CCI give instructions
At that time, the CCI directed Google to prevent Google from participating in anti-competition activities and make changes in its behavior within a fixed time frame. The CCI’s decision said that Google is being fined about seven percent, which is of the average related turnover of Google. The penalty is imposed to violate Section 4 of the Competition Act, 2002, which prevents any company or group from misusing its main condition.
Although the NCLAT did not completely dismiss the findings of the CCI, but kept some of its two. Just rejected some parts of the CCI order, in which Google was found guilty under sections 4 (2) (b) (ii) and section 4 (2) (c) of the Act. These provisions refuse to prevent major institutions from preventing technical or scientific development and entering competitors in the market.
