Maharashtra Speaker Rahul Narvekar on Wednesday said, “…just because you approach the court, it does not mean that the order passed by the Speaker is overturned.” His statement comes at a time when the Uddhav Thackeray faction is considering approaching the Supreme Court against Narvekar’s decision on the disqualification petitions.

Narvekar said one has to “establish that it (the decision) is illegal or untenable in the eyes of law.” And, the Maharashtra president said late on Wednesday night, the Uddhav Thackeray faction’s “baseless allocations do not corroborate this”.

Narvekar also described the allegations of “match fixing” just before the verdict as “baseless”. He said that he does not have to perform his other duties as an MLA and member of the legislative board. “There is no provision under the law which says that when the Speaker is giving judgment on disqualification petitions, he should not perform his other duties,” he said.

“I am a member of a legislative board…the chief minister is a member. We have to meet every month to discuss various issues related to the board. After the Maharashtra Assembly Speaker pronounced the verdict in favor of Shinde faction’s Shiv Sena, Uddhav Thackeray faction leader Sanjay Raut said that this is all match fixing and they will approach the Supreme Court. Earlier, Thackeray had raised objection on one Meeting between Narvekar and ShindeJust before the verdict in Shiv Sena MLA disqualification case.

Maharashtra president Rahul Narvekar delivered the verdict on cross-petitions by Shiv Sena factions seeking disqualification of MLAs from the rival group following the split in the party in June last year. “When rival factions emerged, the Shinde faction was the real Shiv Sena,” Narvekar said in his judgment on Wednesday.

While delivering his important decision, the Speaker discussed Shiv Sena’s constitution in detail and said, “The decision of the party chief cannot be taken as the decision of a political party”.

“In my view, the 2018 leadership structure (submitted with the ECI) was not as per the Shiv Sena constitution. As per the party constitution, the Shiv Sena party chief cannot remove anyone from the party…Uddhav Thackeray has asked Eknath Shinde or any party leader Removed from the party as per the party’s constitution. Therefore, removal of Eknath Shinde by Uddhav Thackeray in June 2022 is not accepted on the basis of Shiv Sena’s constitution,” the president said.

The Supreme Court had last month asked Maharashtra Assembly Speaker Rahul Narvekar to give his decision by January 10 on the disqualification petitions filed by Shiv Sena factions of Chief Minister Eknath Shinde and Uddhav Thackeray.
